General hire terms
Terms & Conditions
These Terms & Conditions apply to all equipment hired from QLD Baby Hire.
By placing a booking, making payment, accepting these Terms & Conditions at checkout and/or receiving the Equipment, the person making the booking (“the Hirer”, “you” or “your”) agrees to be bound by these Terms & Conditions.
Your booking confirmation, the Equipment selected, any accessories or extras, the hire fees, applicable security bond and the hire dates selected at checkout form part of your Hire Agreement with QLD Baby Hire.
1. Equipment
“Equipment” means all products hired from QLD Baby Hire under your booking, together with any accessories, attachments, bags, bases, chargers, cables, mattresses, covers, inserts, adaptors, boards or other components supplied with them.
All Equipment remains the property of QLD Baby Hire at all times.
You must not sell, sub-hire, lend, transfer, dispose of or otherwise give possession of the Equipment to another person without prior approval from QLD Baby Hire.
Product-specific instructions or additional conditions may apply to particular Equipment and form part of these Terms where provided.
2. Hire Period
The Hire Period begins on the commencement date selected during checkout and shown on your booking confirmation.
The Hire Period ends on the return date selected during checkout and shown on your booking confirmation.
The Equipment must be returned by the agreed return date and time unless QLD Baby Hire has approved an extension.
The hire does not automatically extend because the Equipment has not been returned.
Any minimum hire period will be displayed on the applicable product listing or during checkout.
3. Booking Confirmation and Payment
A booking is considered confirmed once QLD Baby Hire has accepted the booking and the required hire payment has been received.
Unless otherwise agreed, all hire fees must be paid before the Equipment is collected or delivered.
The price payable is the price shown for the Equipment, Hire Period and any selected extras at the time the booking is confirmed.
Additional charges may apply for services such as delivery, collection, extensions or optional accessories where selected or subsequently requested.
4. Cancellation Policy
Please read this section carefully before confirming your booking.
Once a booking is confirmed, the Equipment is reserved specifically for your selected dates and removed from availability for other customers.
For this reason, customer-initiated cancellations are non-refundable.
This includes cancellations because of:
- change of mind;
- changes to travel plans;
- cancelled or changed flights;
- illness or personal circumstances;
- no longer requiring the Equipment;
- finding alternative Equipment;
- booking the incorrect item;
- booking incorrect dates;
- cancellation of accommodation or events; or
- any other change in the Hirer’s circumstances.
No refund for cancelled bookings
If you choose to cancel a confirmed booking, the hire amount already paid will not be refunded.
This applies regardless of how far in advance the cancellation is made, unless QLD Baby Hire expressly agrees otherwise or a refund is required by law.
Booking credits
QLD Baby Hire may, at its sole discretion, offer a credit towards a future booking as a gesture of goodwill.
A credit is not guaranteed and QLD Baby Hire is under no obligation to provide one.
Where a credit is offered:
- the amount and any expiry date will be advised at the time;
- the new booking remains subject to availability;
- any price difference must be paid;
- credits are not redeemable for cash; and
- credits are not transferable unless QLD Baby Hire agrees otherwise.
Providing a credit on one occasion does not create an obligation to provide a credit for future cancellations.
No-shows and same-day cancellations
No refund will be provided where the Hirer:
- does not arrive to collect the Equipment;
- is unavailable for an agreed delivery;
- cancels on the commencement date;
- cancels after collection or delivery; or
- cancels after the Hire Period has commenced.
Consumer rights
This cancellation policy applies to customer-initiated cancellations and changes of mind.
It does not remove any rights or remedies you may have under the Australian Consumer Law where QLD Baby Hire fails to meet an applicable consumer guarantee. Australian businesses are not required to provide a refund simply because a consumer changes their mind, but they cannot use a “no refunds” policy to remove statutory rights where goods or services have a qualifying problem.
5. Changes to Booking Dates
Requests to change booking dates are subject to availability and must be approved by QLD Baby Hire.
A request to change dates does not automatically cancel or transfer the existing booking.
QLD Baby Hire may, at its discretion, allow a booking to be moved to alternative dates.
If alternative dates are unavailable, the original booking remains subject to the Cancellation Policy above.
Any difference in price for the new dates or Hire Period must be paid before the change is confirmed.
6. Early Returns
If you voluntarily return the Equipment before the selected return date, no refund or partial refund will be provided for the unused Hire Period.
The Equipment was reserved for you for the full Hire Period and may have been unavailable for hire to other customers during that time.
This does not affect any rights you may have where Equipment has a qualifying fault or where a remedy is otherwise required by Australian Consumer Law.
7. Security Bond
A refundable security bond may be required for certain Equipment.
Where applicable, the amount will be displayed during the booking process or communicated before the Equipment is released.
The bond will be held until the Equipment has been returned and inspected.
QLD Baby Hire may deduct reasonable amounts from the bond for:
- damage beyond fair wear and tear;
- lost or stolen Equipment;
- missing parts or accessories;
- excessive cleaning or remediation;
- unauthorised alterations or repairs;
- late return charges;
- failure to return Equipment; or
- reasonable repair or replacement costs.
If the amount reasonably payable exceeds the security bond, the Hirer remains responsible for the outstanding balance.
Any remaining bond will be released following inspection of the returned Equipment. Bank or payment-provider processing times may apply.
8. Condition of Equipment
QLD Baby Hire takes reasonable steps to ensure Equipment is clean, maintained and in suitable working condition before hire.
As the Equipment is hired and reused, minor cosmetic marks consistent with normal use may be present.
QLD Baby Hire may photograph or otherwise document the condition of Equipment before and after each hire.
You should inspect the Equipment when you receive it and notify QLD Baby Hire as soon as reasonably possible if you identify:
- significant damage;
- missing parts;
- a fault;
- an operational issue; or
- anything that may affect safe use.
Equipment that appears unsafe must not be used.
9. Use of Equipment
The Hirer agrees to use all Equipment safely, carefully and only for its intended purpose.
The Hirer must:
- comply with all manufacturer instructions, warnings and recommendations;
- comply with applicable age, height, weight and developmental limits;
- use all required harnesses, restraints and safety features;
- provide appropriate adult supervision;
- ensure Equipment is correctly assembled before use; and
- stop using Equipment immediately if it becomes damaged or appears unsafe.
The Equipment must not be used for any purpose for which it was not designed.
10. Manufacturer Instructions
The Hirer is responsible for familiarising themselves with the applicable manufacturer instructions before using the Equipment.
Instructions may be supplied:
- with the Equipment;
- electronically;
- by QR code or website link; or
- directly by the manufacturer.
If you are unsure how to safely operate or assemble Equipment, contact QLD Baby Hire before using it.
11. Alterations and Repairs
The Hirer must not:
- alter or modify Equipment;
- dismantle Equipment other than as required for normal use;
- carry out repairs;
- arrange third-party repairs;
- drill, glue, cut or permanently attach anything;
- modify harnesses or safety components;
- remove safety labels or serial numbers; or
- use incompatible or unapproved accessories,
unless QLD Baby Hire has provided prior approval.
If Equipment becomes damaged or faulty, contact QLD Baby Hire before attempting to repair it.
12. Care of Equipment
The Hirer is responsible for taking reasonable care of the Equipment from the time it is collected, delivered or otherwise received until it has been returned to and received by QLD Baby Hire.
Equipment must be protected from avoidable damage including:
- excessive heat;
- inappropriate exposure to water;
- mould;
- burns;
- smoke or vape contamination;
- pet damage;
- excessive staining;
- rough handling;
- inappropriate storage; and
- misuse.
Normal and reasonable fair wear and tear is accepted.
13. Cleaning
QLD Baby Hire cleans and prepares Equipment between hires.
Equipment does not need to be professionally cleaned before return but should be returned in a reasonably tidy condition.
Do not use:
- bleach;
- harsh chemicals;
- abrasive products; or
- cleaning methods inconsistent with the manufacturer’s instructions.
QLD Baby Hire may charge a reasonable additional cleaning or remediation fee where Equipment is returned with soiling significantly beyond ordinary use.
This may include excessive:
- food residue;
- bodily fluids;
- staining;
- mould;
- smoke or vape odour;
- pet contamination; or
- similar contamination.
14. Damage, Loss and Missing Equipment
The Hirer is responsible for the Equipment while it is in their possession or control.
Any damage, loss, theft or missing components must be reported to QLD Baby Hire as soon as reasonably possible.
Where Equipment is stolen, QLD Baby Hire may request details of the incident and a police report or event number.
Where damage or loss results from misuse, negligence, failure to follow manufacturer instructions or breach of these Terms, the Hirer may be responsible for the reasonable repair cost.
If repair is not reasonably possible, the Hirer may be responsible for the reasonable replacement cost of the Equipment or missing component.
Any security bond held will be applied towards amounts properly payable, but the Hirer remains responsible for costs exceeding the bond.
15. Faulty Equipment
QLD Baby Hire checks Equipment before hire.
If Equipment develops a fault during the Hire Period, the Hirer must notify QLD Baby Hire as soon as possible.
Where appropriate, the Hirer should stop using the Equipment until further instructions are provided.
Where reasonably available, QLD Baby Hire may arrange:
- troubleshooting;
- repair;
- replacement Equipment;
- an alternative item; or
- another appropriate remedy.
Where the issue was caused by misuse, neglect, accidental damage, improper handling or failure to follow manufacturer instructions, the Hirer may be responsible for repair or replacement costs.
Nothing in this section limits any rights or remedies available under Australian Consumer Law.
16. Late Returns
Equipment must be returned by the agreed return date and time.
If Equipment is returned late without an approved extension, additional hire charges may apply.
Where a late return affects another customer’s confirmed booking, the Hirer may also be responsible for reasonable additional costs directly caused by the late return.
QLD Baby Hire may take reasonable steps to recover Equipment that has not been returned.
17. Hire Extensions
If you would like to keep Equipment beyond the original selected return date, you must contact QLD Baby Hire before the Hire Period expires.
Extensions:
- are subject to availability;
- are not guaranteed;
- must be approved by QLD Baby Hire; and
- may require additional payment before the extension begins.
Another booking may already be scheduled immediately after yours, so continuing to retain Equipment does not constitute an approved extension.
18. Collection and Delivery
For collection bookings, responsibility for the Equipment passes to the Hirer when the Equipment is handed over to the Hirer or their authorised representative.
For delivery bookings, responsibility passes when the Equipment is delivered to the Hirer or their authorised recipient.
The Hirer is responsible for providing accurate collection, delivery and contact details.
If an agreed delivery or collection cannot be completed because:
- incorrect information was provided;
- access cannot be obtained; or
- the Hirer is unavailable at the agreed time,
a reasonable additional delivery or collection charge may apply.
19. Identification
QLD Baby Hire may require the Hirer to provide valid photo identification and evidence of their current residential address.
QLD Baby Hire may refuse to release Equipment where requested identification has not been provided.
Any resulting inability to collect Equipment does not automatically entitle the Hirer to a refund where the identification requirement was disclosed before hire.
20. Travel and Third-Party Handling
The Hirer remains responsible for Equipment while travelling with it.
This includes periods where Equipment is handled by:
- airlines;
- baggage handlers;
- hotels;
- transport providers;
- friends or family members; or
- other third parties.
The Hirer is responsible for checking airline, accommodation, transport and destination requirements before travel.
QLD Baby Hire does not guarantee that a particular airline will accept any item as cabin baggage, checked baggage or approved onboard Equipment.
Any third-party or airline damage should be photographed and reported to QLD Baby Hire as soon as reasonably possible.
21. Product Safety and Recalls
If QLD Baby Hire becomes aware of a safety issue or recall affecting hired Equipment, QLD Baby Hire may contact the Hirer and require the Equipment to stop being used immediately.
The Hirer agrees to comply with reasonable safety directions and assist with return, inspection or replacement of affected Equipment.
22. Availability and Substitution
QLD Baby Hire will make reasonable efforts to supply the Equipment booked.
Occasionally an item may become unavailable because of:
- damage from a previous hire;
- a late return;
- mechanical or safety issues;
- product recalls; or
- circumstances beyond QLD Baby Hire’s reasonable control.
Where this occurs, QLD Baby Hire may offer an equivalent or suitable replacement.
The Hirer does not have to accept a materially different substitute.
If QLD Baby Hire cannot supply the booked Equipment or a suitable alternative, the amount paid for the unavailable Equipment will be refunded.
23. Cancellation by QLD Baby Hire
QLD Baby Hire may cancel or terminate a booking where reasonably necessary, including where:
- Equipment becomes unsafe or unavailable;
- required payment has not been received;
- required identification has not been provided;
- the Hirer materially breaches these Terms;
- Equipment is being used unsafely or unlawfully; or
- QLD Baby Hire reasonably believes its Equipment is at significant risk.
Where QLD Baby Hire cancels a booking before commencement for reasons unrelated to a breach by the Hirer and cannot provide a suitable alternative, any hire amount paid for the affected Equipment will be refunded.
24. Liability
QLD Baby Hire takes reasonable steps to provide Equipment in safe and working condition.
The Hirer is responsible for the safe and appropriate use of the Equipment throughout the Hire Period.
To the extent permitted by law, QLD Baby Hire is not responsible for injury, loss or damage resulting from:
- misuse of Equipment;
- failure to follow manufacturer instructions;
- use outside stated limits;
- incorrect installation or assembly by the Hirer or a third party;
- unauthorised modifications or repairs;
- use of unapproved accessories;
- negligent handling; or
- continued use after damage or a safety concern becomes apparent.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot legally be excluded under the Australian Consumer Law. Consumer guarantee rights cannot be removed by a business’s terms or a blanket “no refunds” statement.
25. Termination and Recovery of Equipment
QLD Baby Hire may terminate the Hire Agreement where the Hirer:
- materially breaches these Terms;
- fails to pay amounts properly due;
- fails to return Equipment;
- unlawfully transfers possession of Equipment; or
- uses Equipment in an unsafe or improper manner.
Following termination, the Hirer must immediately arrange for the Equipment to be returned.
QLD Baby Hire may take reasonable steps to recover its Equipment and may recover reasonable costs directly arising from a wrongful failure to return it.
26. Electronic Acceptance
By completing checkout and accepting these Terms & Conditions, the Hirer confirms that they:
- are at least 18 years old;
- have read and understood these Terms;
- agree to the cancellation and no-refund policy;
- agree that the hire dates are the dates selected during checkout;
- agree to pay applicable damage, loss, cleaning, late return or replacement costs where properly payable; and
- agree to comply with applicable manufacturer instructions.
Entering the Hirer’s full name into the signature field at checkout constitutes electronic acceptance of the Hire Agreement.
QLD Baby Hire may retain the booking details, acceptance date and time, Terms & Conditions version and electronic signature as evidence of the Agreement.
27. Australian Consumer Law
These Terms are intended to operate alongside, and not replace, rights available under the Australian Consumer Law.
The “no refund on cancellation” policy applies to customer-initiated cancellations and changes of mind. It does not apply where the law requires QLD Baby Hire to provide a refund or another remedy.
The ACCC confirms businesses generally do not have to provide a refund simply because a consumer changes their mind, but consumer guarantees continue to apply when there is a qualifying problem with a product or service.
28. Governing Law
These Terms & Conditions are governed by the laws of Queensland, Australia.
